The General Terms of Business of CARLTON nekretnine - real estate govern the business relationship between CARLTON nekretnine - real estate and a natural or legal person (hereinafter referred to as the principal) who concludes a brokerage contract with CARLTON nekretnine - real estate.

RENTAL/LEASE MEDIATION
When the landlord/lessor orders CARLTON nekretnine - real estate to mediate in the rental/lease of his property, or when the tenant/lessee orders CARLTON nekretnine - real estate to put him in touch with a person who would negotiate with him about concluding a rental/lease agreement or when the tenant/lessee orders CARLTON nekretnine - real estate to mediate in finding a suitable property for rental/lease, and CARLTON nekretnine - real estate will conclude a contract/order for mediation with him.
CARLTON nekretnine - real estate's obligations are to verify the ownership of the property that is the subject of the rental/lease, to make a presentation of the property in question, to conduct the negotiations necessary to reach an agreement for the rental/lease of the property in question, to obtain the preparation of a rental/lease agreement, and to attend the handover of the property, during which a handover report is drawn up.

BROKERAGE FEE FOR RENT/LEASE
The HGK PRICE LIST is used to determine the amount of the intermediary fee. The agency fee is paid when signing the rental agreement.

RENTING - commission from the lessor/lessor:
- for rent/leases of less than a year: calculation amount of monthly rent/lease
- for rent/lease from 1 to 5 years: 100% of the monthly rent/lease
- for rent/lease for a duration of 5 years and more: 150% of the monthly rent/lease

The Intermediary is also entitled to Compensation if the spouse, i.e. common-law partner, descendant or parent of the Principal concludes a legal transaction for which the Intermediary mediated with a third person with whom the Intermediary brought the Principal into contact.


RENTING
 - commission from the lessee/lessee:
- for less than a year's rent: 100% of the monthly rent
- for rent/lease from 1 to 5 years: 100% of the monthly rent/lease
- for rent/lease for a duration of 5 years and more: 150% of the monthly rent/lease

The Intermediary is also entitled to Compensation if the spouse, i.e. common-law partner, descendant or parent of the Principal concludes a legal transaction for which the Intermediary mediated with a third person with whom the Intermediary brought the Principal into contact.


MEDIATION FOR THE SELLER
When the Seller orders CARLTON nekretnine - real estate to mediate the sale of his real estate, CARLTON nekretnine - real estate will enter into a mediation agreement with the seller.
With the agreement on mediation in real estate transactions, CARLTON nekretnine - real estate undertakes to perform the following in particular for the seller (principal):
1. to try to find and connect a person with the client in order to conclude a mediated deal,
2. inform the client of the average market price of similar real estate,
3. inspect the documents proving the ownership or other real right to the property in question and warn the client of: obvious defects and possible risks related to the unregulated land registry state of the property, registered real rights or other rights of third parties to the property, legal consequences of non-fulfillment of obligations towards a third party, deficiencies in building and use permits in accordance with a special law, circumstances of the obligation to apply the right of first refusal and restrictions in legal transactions in accordance with special regulations.
4. perform the necessary actions to present the property on the market, advertise the property in an appropriate manner and perform all other actions agreed upon in the real estate brokerage contract that go beyond the usual presentation, for which he is entitled to special, pre-specified costs,
5. enable the inspection of the property,
6. mediate in negotiations and strive to conclude a contract
7. if the subject of the contract is land, check the purpose of the land in question in accordance with the spatial planning regulations relating to that land.


BROKERAGE FEE BY THE SELLER
The Croatian Chamber of Commerce PRICE LIST is used to determine the amount of the brokerage fee. The agency fee is paid when signing the preliminary contract for the purchase and sale of real estate.
Immediately after concluding the mediated legal transaction, or the preliminary contract by which the agent undertakes to conclude the mediated legal transaction, if the CARLTON Real Estate Agency and the principal have agreed that the right to payment of the brokerage fee is acquired already upon concluding the preliminary contract, the agent shall pay the CARLTON Real Estate Agency a brokerage fee (commission), unless otherwise agreed
For the brokerage service provided in the purchase and sale of real estate, CARLTON Real Estate will charge a commission from the seller in the amount of 2-3% of the agreed purchase price.
The agent is also entitled to the Fee if the spouse, or common-law partner, descendant or parent of the Principal concludes a legal transaction for which the Agent mediated with a third person with whom the Agent brought the Principal into contact.
CARLTON real estate - real estate reserves the right to change the amount of the brokerage fee, which is precisely determined in the brokerage contract. The total fee may not exceed 6% of the purchase price of the property.

INTERMEDIATION FOR THE BUYER
When the buyer gives an order for CARLTON real estate - real estate to put him in touch with the seller of the property or when the buyer gives an order for CARLTON real estate - real estate to mediate in the purchase of the property, CARLTON real estate - real estate signs a brokerage contract/order with the buyer. With the agreement/order on mediation in real estate transactions, CARLTON nekretnine - real estate undertakes to perform the following in particular for the customer (principal):
1. present the buyer with proof of ownership of the property that is the subject of the sale
2. organize signature verification on the pre-contract and the contract on the purchase and sale of real estate at the notary's office,
3. in the event that the purchase price is paid in part or in full with a bank loan, attend the solemnization of the loan agreement at the notary public, after which the proposal for registration of the mortgage is taken to the Land Registry Department of the competent court for registration of the mortgage,
4. after the mortgage is registered, deliver the decision and an extract from the land register with the registered mortgage to the buyer,
5. to attend the payment of the purchase price and the handover of the real estate, during which the record of the handover of the real estate is drawn up,
6. inform the customer about the legal obligation to pay real estate sales tax or the conditions for exemption from real estate sales tax.

The Broker is also entitled to a Fee if the spouse, or common-law partner, descendant or parent of the Principal concludes a legal transaction for which the Broker mediated with a third person with whom the Broker brought the Principal into contact.
CARLTON nekretnine - real estate reserves the right to change the amount of the brokerage fee, which is precisely determined by the brokerage contract. The amount of the total fee may not exceed 6% of the purchase and sale price of the real estate.

BROKERAGE FEE
The Broker is entitled to a Fee if the spouse, or common-law partner, descendant or parent of the Principal; i.e. a trading company, institution or other legal entity that the Principal, his spouse or common-law partner, descendant or founding parent or legal representative, i.e. with which he has concluded an employment contract or a work contract, concludes a mediated legal transaction with the person with whom the Intermediary brought the Principal into contact.

INTERMEDIATE HOURLY WAGE
If it is expressly agreed, the mediator in agreement with the client can also perform other services for him in connection with the work that is the subject of mediation, which exceed the usual mediation costs, and in that case the mediator's hourly rate will amount to EUR 80.00.

CONTRACTUAL PENALTY
The contracting parties determine the right of the Intermediary to a contractual penalty in the amount of 5% of the agreed purchase price that the Principal as the seller or buyer contracts with the buyer or seller with whom the Intermediary entered into a relationship
action and with whom, after establishing a relationship, independently, excluding and/or bypassing the Intermediary, entered into a legal transaction of purchase and sale, and did not pay the agreed fee to the Intermediary.
In the event that the work is not realized, and the legal document is sent to the parties by an expert and authorized person, the Agency charges for the drafting of the contract according to the following criteria:

1.) Monolingual apartment rental agreement EUR 230.00
2.) Monolingual solemnized apartment rental agreement EUR 300.00
3.) Bilingual apartment rental agreement EUR 350.00
4.) Real estate purchase agreement* EUR 500.00
5.) Preliminary real estate purchase agreement* EUR 450.00
*The price applies exclusively to the preparation of contracts for registered real estate, without a complex legal sequence of documentation, without mortgages, registered disputes and active seals.
